Terms of Use for Umanity Services

Welcome to Umanity! All our users can take advantage of Umanity services according to these Terms of Use. Registering as a Umanity member and using our services is deemed as agreeing to the content of these Terms of Use. For information on utilizing special services, please refer to our User’s Guide. Please note that this agreement includes the User’s Guide.

Article 1 (Definitions)
Umanity (hereafter, the Site) refers to the generic name for all the content and information provided by Umanity Ltd. (hereafter, the Company), including web-based horse racing information services and mail services related to the Site.
Article 2 (Members)
1. A member of the Site means a person who has applied to be a registered member of the Site according to our predetermined method and who has been recognized by the Company as a registered member.
2. By the act of registering, members agree to abide by the content of these Terms of Use.
3. Members are responsible for the content of their own personal and other information which they enter during registration.
Article 3 (Terms & Conditions of Service)
1. Members agree that the Site may add, alter or terminate the content of services provided to members, at the discretion of the Company, without prior notice to the member.
2. Members agree that the Site may send a variety of emails, including important notices, as a part of the functions or notices about the operation of its services to the registered address of the member.
3. Members agree that the Site may include advertisements of 3rd parties in any and all pages related to the services of the Site, as well as in emails sent to members.
4. Members agree that the Company may check the content entered by a member related to its Services, if it confirms the content has the potential to or in fact does violate prohibited uses and/or laws or regulations, the Site may delete said content and/or report it to the authorities if necessary.
5.Members agree that any information, comments, content, points, Gold, Uma-Yen, etc., may be shared or linked from the Site to sites other than those administered by the Company, such as those provided for cell phone, PC or smartphone.
Article 4 (Granting & Use of Points)
1.When a member uses an eligible service specified by the Company, or specific paid services, the Company shall grant “points” according to the conditions set forth by the Company.
2.The Company shall, at its discretion, determine which transactions are eligible for awarding points, the period during which points are awarded, the rate thereof, the valid period of points, the maximum number that can be awarded within a certain period, and any other conditions related to granting points, as well as the method of giving notice thereof, in accordance with the Act on Prizes and any other applicable laws or regulations.
3.Members may not transfer or assign their points to any 3rd party.
4.Members may exchange awarded points for specific prizes or products according to the method specified by the Company. Information on what products are available and how to exchange for them shall be made available to members by the method set forth by the Company.
5.Members may use Uma-Yen granted to them from the points awarded to them by the conditions set forth by the Company at the websites and at the exchange rate specified by the company.
6. The valid period of a member’s points shall be 180 days after the last date acquired or spent.
Article 5 (Handling of Personal Information)
The Company shall handle personal information appropriately according to the Privacy Policy posted elsewhere.
Article 6 (Prohibited Conduct)
Members shall not engage in the following conduct and if they do so, the Company may suspend or cancel their membership without notice or consent. Also, note that determination of whether a violation has occurred or not shall be made by the Company.
1. Conduct that interferes with the operation of the Site or the system
2. Fraudulent changes to, falsification or deletion of content
3. Conduct such as sending or writing harmful computer programs
4. Conduct injurious to the reputation, trust in or privacy rights of the Company or any 3rd party
5. Conduct contrary to public order or morals
6. Criminal acts or any conduct that leads to, or could lead to criminal acts
7. Impersonation of another member
8. Conduct that infringes on privacy rights or intellectual property rights, such as copyrights, trademark or patents, of the Company or any 3rd party
9. Slander, intimidation, harassment or any other conduct that inflicts economic or emotional harm or disadvantage on another member
10. Offensive criticism that targets a specific other member’s user ID, nickname, name, etc.
11. Posting expressions that lead to discrimination based on ethnicity, race, gender, age, etc
12. Posting images (illustrations), videos or the like, that include violent expressions or depictions, or posting expressions judged to be obscene
13. Posting links to adult sites or downloads of child prostitution or pornography, uncensored video footage
14. Conduct that solicits or incites meetings for the purpose of sexual intercourse or indecent acts
15. Conduct for the purpose of commercial activities, such as selling goods, or for making money
16. Conduct such as posting the following kinds of content in fields within Umanity that can be written in, or sending it in messages
(1) Information whose purpose is advertising or publicity for commercial aims
(2) Information that contains links to affiliates
(3) Solicitations for Ponzi schemes, chain letters, multi-level marketing schemes, paid-to-read mail, etc.
(4) Inducements to adult sites (including pasting links)
(5)Conduct such as sending spam, soliciting additional Uma-Friends or that leaves a footprint
(6) Posting identical or similar text, or sending such content in messages
(7) Conduct such as posting words or phrases multiple times in writable fields on Umanity, which are unrelated to the place posted
(8) Posting remarkably long text or an excessive number of words
(9) Posting the same URL in fields within Umanity that members can write in, or sending it in messages
(10) Any other conduct the Company judges to be spam
17. Conduct such as impersonating someone else, claiming to represent a company or organization despite having no right to represent it or act as its agent, or pretending to have a tieup or collaborative relationship with another person or organization
18. Collecting or accumulating the personal information of other members
19. Conduct such as the unauthorized copying, reproduction, uploading, posting, transmitting or otherwise distributing descriptions related to the services on Umanity
20. Maintaining more than one account
21. Allowing more than one person to use the same account
22. Use by a minor (under 20 years of age)
23. Any other conduct in violation of these Terms of Use
Article 7 (Penalties for Violations)
1. If a violation of this agreement comes to light, the Company may discontinue the use of all registrations of that member and/or unilaterally cancel the membership. Furthermore, the Company shall bear no liability whatsoever for any damage the user suffers thereby.
2. If the user has obtained prizes, products or the like through unfair practices that deviate from the operational spirit of the services, the Company shall be able to revoke them.
Article 8 (Disclaimers)
1. The Company shall assume no responsibility for nor bear any obligation for restitution for any damages suffered by a member or any 3rd party that arises from using the Site.
2. The Company makes no warranties of any kind about the information provided on the Site (including content, advertisements or any other information provided by 3rd parties)
3. Umanity does not participate in communication or activities between members, but if some kind of trouble should result between such parties, unless we judge there to be a malicious act, it shall be resolved between the parties concerned and the Company shall bear no responsibility.
4. The posting of images, such as to profiles, diaries, etc., shall be at the sole responsibility of the member. Prior to posting, please give due consideration to issues such as whether it meets legal obligations in terms of copyrights and/or right to use an image, as well as to the potential saving of data or use of reproductions.
5. The Company may, at any time and for any reason interrupt the services of Umanity.
6. Although scrupulous care is taken with the content of the racing information and racing tips that are posted on the Site, we make no warranties as to its accuracy or security. The Company that operates Umanity shall bear no responsibility whatsoever for any damages, losses or disabilities suffered based on any information we supply
7. The information service and predictions the Company provides is, after all, about predicting horse races, which includes all kinds of risk and uncertain factors and elements. When a member uses the content, you agree that you are doing so on a full understanding of the above and you take full responsibility for determining for yourself the reliability, accuracy, completeness, usefulness and benefit of the content, as well as for taking the concomitant risks.
8. Carefully review each site whose links appear within the Site as we do not bear any responsibility for the legality, morality, copyright permission, accuracy, etc., of the content maintained on those websites. Also, the information on the Site is subject to change or deletion without notice. Please bear this in mind.
Article 9 (Temporary Interruption of the Site)
The Company may in the following circumstances interrupt access to the Site to members without prior notice.
1. For the purposes of system maintenance and periodic updates in order to provide the Site, or in the case of emergency.
2. If it becomes difficult to provide services due to fire, power outage or force majeure, such as natural disaster.
3. If the type I telecommunications provider fails to provide its services
4. If the Company determines it is difficult to provide services for any other reason.
Article 10 (Paid Services)
Umanity provides two types of paid services under the following conditions, a monthly fee-based service, Umanity VIP Club and a pay for points system, Gold (G).
1. Sign-up
The Site may be used after signing up according to the procedure specified by the Company (method explained on the Site)
2. Payment method
Users may choose from among the following 6 payment methods for monthly fee-based services.
(1) Credit card payment (VISA, Master Card, JCB, Amex)
(2) docomo Mobile Payment
(3) au EZ FeliCa
(4) Internet provider payment (Yahoo! Wallet, BIGLOBE)
(5) E-money (BitCash)
(6) Net banking (Japan Net Bank, Rakuten Bank)
Users may choose from among the following 7 payment methods for pay for points services.
(1) Credit card payment (VISA, Master Card, JCB, Amex)
(2) docomo Mobile Payment
(3) au EZ FeliCa
(4) Softbank Pay Together
(5) E-money (BitCash)
(6) Net banking (Japan Net Bank, Rakuten Bank)
(7) Pay via iPhone/iPad app (In App Purchase)
3. Period of Use
The period of us for monthly paid services (Umanity VIP Club) depends on the payment method.
(1) 30 days from date of sign-up
- Credit card payment (*Automatically renews on the same day of the month as original sign-up)
- E-money (BitCash)
- Net banking (Japan Net Bank, Rakuten Bank)
(2) To end of month from date of sign-up
- docomo Mobile Payment
- au EZ FeliCa
- Internet provider payment (Yahoo! Wallet, BIGLOBE)
[Warning] The period of use is until the end of the month, but full monthly fees apply even when signing up mid-month.
4. Initiating use
- Monthly fee-based services, are provided from the point of logging in after completing sign-up and logging out. 5. Usage fees
The usage fees for paid services, usage method and calculation methods are as set for separately by the Company. Please note that usage fees may be changed if the Company deems it necessary. In such case, the Company will give advance notice.
6. Payment
Members shall pay for paid services via a payment method established by the Company. Please note that payment methods may change due to circumstances of the Company. Also, payment of usage fees for monthly fee-based services (Umanity VIP Club) shall continue in effect until the member him/herself terminates the membership ; this is limited to payment via credit card or Internet provider.
7. Cancellation of sign-up
After signing up for paid service, the application cannot be canceled and fees will not be returned for any reason whatsoever.
8. Withdrawal (cancellation)
Withdrawal from monthly fee-based services (Umanity VIP Club) must be done by the member him/herself according to the procedures set forth by their payment company.
9. Refunds
If the services are interrupted temporarily during the usage period, due to communications line failure, server failure or the like, refunds cannot be made from the usage fees that have already been received. Further, no refund whatsoever can be made for usage fees already received, when due to reasons from the foregoing paragraph.
10. Suspension of use of services
If usage fees are not paid, the use of paid services may be suspended without notifying the member.
Article 11 (Use of Registration Information)
1. The information provided during member registration is used for the purposes of providing services on the Site to the member and for personal authentication.
2. The Company may send email advertising to members and asks for their cooperation with questionnaires and surveys.
3. The Company may create statistical data in a format that does not allow the identification of individuals, based on registration information, and use of this data may be utilized without restriction.
Article 12 (Intellectual Property Rights, etc.)
1. All the rights (ownership, intellectual property rights, likeness rights, publicity rights, etc.) that constitute the Services, including but not limited to the text (diaries, topics, comments, predictions, etc.) images, program and other data, shall belong to the Company, or 3rd parties who own certain rights, except in the case of creations of members themselves.
2. When a member creates a work him/herself and posts it to our Service, it is assumed that permission is granted to the Company to use it for publicity or advertising purposes. And, when used in this way, the member shall not exercise any personal authorship rights.
3. When a member posts a tip that s/he has registered him/herself on this Site, it is deemed to be permission for the Company to sell it to other members via the mobile sites or websites operated by the Company. And, when used in this way, the member shall not exercise any personal authorship rights.
4. If a member runs into problems such as 3rd party infringement of rights related to their own works, the member shall resolve it at their own expense and responsibility and shall hold the Company harmless and not create a nuisance.
Article 13 (Withdrawal & Expulsion of Members)
1. When a member wishes to withdraw from the Site, s/he shall apply to do so via the procedures set forth by the Company (Withdrawal Form).
2. If it is discovered that a membership registrant is a minor, the Company may expel the member from the Site without any prior notice to the member whatsoever, or temporarily suspend their use thereof.
3. If the Company determines this agreement has been violated, the Company may expel the member from the Site without any prior notice to the member whatsoever, or temporarily suspend their use thereof.
Article 14 (Change to Terms of Use)
The Company may, at any time and without prior notice to members, change, add to or delete these Terms of Use, and shall display said changes, additions or deletions to the Terms of Use on the Site; after displaying them, when the member uses the Site again, s/he is deemed to have accepted them.
Article 15 (Jurisdiction)
If the need for litigation should arise between a member and the Company, the court having jurisdiction over the head offices of the Company shall be the court of exclusive jurisdiction between the member and the Company.
■ Umanity PAT (U-PAT) User’s Guide
Umanity PAT (U-PAT) is a betting assistance tool equipped with an auxiliary function for sending the betting combinations and purchase amounts to the IPAT (PC type) = Internet Polling Assistance Tool system operated by JRA (Japan Racing Association). In order to use it, one must first become a member of JAR’s A-PAT (PAT).
- Operating Environment Please use the latest Microsoft Edge or Google Chrome or Safari with Umanity PAT (U-PAT). It may not work properly if any other environment is used.
- Interruption of Service Please note that due to reasons related to the system and/or circumstances related to operating the Site, Umanity PAT (U-PAT) services may be interrupted without notice.
- Important Points 1. Always be sure to check the betting screen of IPAT or the reference screen on IPAT to make sure the betting combinations and purchase amounts have been sent successfully via Umanity PAT (U-PAT). 2. Only the member him/herself may use their INET-ID.
- Disclaimers Umanity and JRA shall bear no responsibility whatsoever for any damages that arise from using Umanity PAT, such as failing to make a bet that a member meant to make, which occurs when using Umanity PAT due to any kind of problem, such as communication failure and including problems with the program.
Betting log User’s Guide
The “Betting log” is a tool for saving the content of bets (betting combinations and purchase amounts) when using Umanity PAT.
Before it is possible to save the content of bets in the Betting log, one must first put a check mark on the radio button “Reflect in Betting log” in Umanity PAT (U-PAT) and then press the Buy Ticket button.
- Important Points [Attention]
Data is saved to the Betting log when the Umanity PAT (U-PAT) Buy Ticket button is pressed. Always be sure to check the betting screen of IPAT or the reference screen on IPAT as the content of bet(s) saved to the Betting log is not a guarantee that they have been sent successfully and received by IPAT (actual betting ticket(s) purchased).
- Disclaimers
Please take all due care because if some kind of problem occurs, such a communication failure or problems with the program, the content of bet(s) may be saved to the Betting log, even though the betting ticket(s) the member meant to make are not processed. Note that Umanity shall bear no responsibility whatsoever for any damages that arise from using the Betting log.
- Operating Environment
Please use Microsoft Edge or Google Chrome or Safari with Umanity PAT (U-PAT). It may not work properly if any other environment is used.
- Interruption of Service
Please note that due to reasons related to the system and/or circumstances related to operating the Site, the Betting log service may be interrupted without notice.
U-Store User’s Guide
U-Store is an online sales service provided to Umanity members by Umanity (Umanity Ltd.) and U-Store product provider companies (hereafter “the Vendor”). Please understand the following points before using the service.
- Purchasing Products
The method of purchasing each product differs, so be sure to confirm the method before use. Also, the member is making a sales contract with Umanity or the Vendor when s/he completes the order procedure.
- Display of Product Prices
Two kinds of prices are displayed per product in the U-Store; one is displayed with a line struck through it, which is the reference price, while the other is the actual price. If there is only one price displayed, that is the actual price.
- Use of Gold
When a product has the number of Gold required to purchase it in the price column, then you may order it using Gold if you have already purchased Gold, which is provided by Umanity for a charge.
- Purchase Limits
The maximum amount of products that may be purchase on Umanity at one time is 300,000 yen (including tax).
- Shipping
The shipping costs depend on the product and the amount purchased, so be sure to confirm these before use.
*Products that can be downloaded do not incur shipping.
- Shipment of Products
Even when the ordering procedures have been completed for a product, the shipment may be delayed due to the inventory level or delivery schedule of Umanity or the Vendor. Please be aware when ordering that we cannot guarantee that the content displayed on the Site is completely satisfactory .
- Cancellation
Please note that after the ordering procedure is complete for a product, it may not be canceled at the member’s discretion.
- Replacement of Products
If the product a member ordered is not the same as that received, or if the product upon delivery is damaged or soiled, we will replace the product. However, please do contact either the Vendor or Umanity within one week of receipt of the product.
- Returns
Some products can be returned even if not defective. Contact the Vendor. However, if you purchase a product for download it cannot be returned.
- Handling of Customer Information
The information entered when a member purchases product(s) is entered into Umanity’s databases, but is strictly managed according to the Umanity privacy policy.
- Vendor Links
Third parties (including individuals) other than Umanity provides services, sell products and post ads on U-Store, and there are links to vendors and some other companies. Umanity does not inspect, evaluate or warrant the products of such companies or individuals, or the content of their websites. We recommend you carefully read the privacy policy of each company, paying particular attention to their Terms of Use.
- Operating Environment
Please use Microsoft Edge or Google Chrome or Safari when using U-Store. It may not work properly if any other environment is used.
- Interruption of Service
Please note that due to reasons related to the system and/or circumstances related to operating the Site, the U-Store service may be interrupted without notice.
